I was involved in a accident where I stopped at the stop and when I proceeded through I was hit by another vehicle. I received a summons where I am being sued by state farm the vehicles owner insurance. My problem is she stated in her claim that she was driving but she was not even in the car and arrived on the scene after the driver called her. I learned that she took to blame for the accident because the driver was her son, who was here illegaly. Do I have any recourse
Turn it over to your insurance company; they'll defend you. If you didn't have insurance, yes, you should hire a lawyer to help you. Otherwise, you'll probably get turned, twisted and tortured with court procedure, and lose. Good luck. Just get it to your insurance company.
Submit this to your insurer at the time of the crash and it will assign counsel and defend you.
In Small Claims court, the court does not normally allow attorneys to be present. You can plead (tell your own side of the story) directly to the Judge and the Judge will make a decision. Good luck.
Mr. Crosner is licensed to practice law in California and has been practicing law in California since 1978. The response herein is general legal and business analysis.. It is not intended nor construed to be "legal advice" but rather it is analysis, and different lawyers may analyze this matter differently, especially if there are additional facts not reflected in the question. Oftentimes the question does not include significant and important facts and timelines that, if known, could significantly change the reply and make it unsuitable. I am not your attorney until retained by a written retainer agreement signed by both of us. See also avvo.com terms and conditions item 9, incorporated as if it was reprinted here. In seeking an attorney on this site, beware of limiting your search to attorneys with a 10 rating, and carefully read the AVVO disclaimer regarding their rating system. There are certain factors that are given great weight which do not necessarily have any bearing on an attorney's experience, abilities, and results with certain types of cases. Accordingly, the rating numbers can be misleading. Also beware of basing your choice on the fee charged, as a low fee, depending on the skill, experience and determination of the specific attorney handling your case, could actually have an inverse relationship to the amount actually put in your pocket.
You need to report this to your auto insurance company and forward the adjuster a copy of the Summons and Complaint and any other attached legal documents such as a Request to Produce or Interrogatories, etc.
I would send the documents via overnight express mail, e-mail, or fax and then follow up with the adjuster the following day as there is a limited time for an attorney to file responsive pleadings on your behalf.
Your insurance company will indemnify and defend you up to the limits of your liability coverage and also provide you with a defense attorney at no cost to you. The attorney will go over any legal questions you have about proper service and the lawsuit process.
Let your insurance company and the attorney it assigns handle this, as this is the specific reason you are paying insurance premiums.
