My friend is unsure whether to focus on I-864 or I-864w during coming Green Card interview soon. The sponsors couple for I-864 refused to give requested documents unless getting paid in advance. My friend refused, hence many requested I-864 documents will be absent for interview. In fact, documents requested by Immigration Department to bring for interview are related to I-864 application.
However, my friend is fully eligible for I-864W due to her salary, and decade of full time work here. Indeed, she filed both I-864 and I-864W and submitted all supporting documents. She isn't sure if officers are confused or simply assumed that she wants to use I-864 instead of I-864W.
Due to sponsor problem but yet she is eligible for waiver using I-864W, what are the impacts and how can she succeed on her interview? Should she bring her list of I-864w documents instead to interview? Can she ask officer simply ignore I-864 and use only I-864w and supporting documents on file? Did she make a mistake on submitting both I-864 AND I-864w, instead of either one? If yes, will that make the case fail?
If the affidavit of support documents were sent with the application, normally they don't have to be provided again at the time of the interview. Also, if your friend qualifies for waiver of the affidavit of support requirement, just bring the forms and the documents that show that her qualifies, and it should be enough.
