I'm USC and I was married here in the US. one year before I divorced my wife here I get married in my home country where polygamy is legal. Now can I file I-130 for my wife and does my marriage will be recognized by USCIS. If so how I can explain recent marriage date was before recent divorce date. Or do I have to divorce my wife and remarry her?. If I file under current situation there is any chance will USCIS approve my case?
I will depends upon the state in which you married your current wife. If a divorce will reactivate the second marriage and make it valid, then you will not have to remarry. You've already married your second wife and therefore when you divorce your second marriage will become valid.
