I bought a car from a auto dealer on 4/20 got it home didn't restart, took it to a mechanic found out that there is actually no frame left to the car. It is all rotted out from rust. the break lines are held together by compression clamps, the gas tank has a hole, was informed that this car is totally unsafe to drive should not be on the road. I understand the as is policy however when you buy a car I expect to not have it be a hazard to myself or anyone else on the road. Please help me.
The “as is“ designation is not a license for a merchant to defraud a consumer. If the dealer had to know that the car was in the condition you describeIt it is possible that you have a claim under among other things the New Jersey Consumer Fraud Act, which provides triple damages and payment of attorneys’ fees. Whether you have such a claim, and whether the dealer you bought the car from is a viable defendant would depend on the specific facts of your situation. You should contact a Consumer Protection Attorney.
