We were married in Texas and I left him last year because our checks were bouncing and he stayed up all day and night on computer, online gambling. Found out later that porn is involved also. His father is wealthy and funds his habits. We have no property together. I have moved 9 times in 12 years for his employment opportunities. After I left him , he moved to Tennessee for his job. We do not communicate . We are both employed. Would I be able to recover 1/2 the gambling loses being they were 1/2 mine? Would I be able to claim 1/2 his retirement? We have been separated a year now with no contact.
You need to confer with a Family Law Attorney so you understand Texas property law a little better. You say, "We have no property together", but Texas is a community property state so everything accumulated during the marriage other than gifts, inheritance or the proceeds of some kinds of separate property is community property and jointly owned. You would be entitled under Texas law to a share of his retirement earned during the marriage if it still exists and your lawyer can freeze it before he spends it. You might have a claim against him for his waste of marital resources if you can prove it. Lawyer up.
