I was unaware that I had ever shown retaliatory behavior towards my 12 employees. I have never been written up, warned etc. Also, I was never trained as a manager when I started a year ago. Yesterday I found out that I am being moved to another position due to retaliatory management. HR said that I should have been talked to about this by my boss each time an employee complained. I was not. Furthermore, no specifics are being given as to what I did wrong. Finally, someone was hired for my position 3 weeks ago and I was not made aware of this until yesterday when they told me I was not allowed to go into the office for the rest of the week due to the fact that it may make the new manager uncomfortable. Was this done legally? Do I have a right to complain to HR about this? I feel blindsided and embarrased.
I would recommend you speak to an employment attorney about this. Your employer could have violated MA law by putting information about this in your personnel file and not notifying you about it (since they said your boss was supposed to speak to you about this). Your question isn't clear enough for us to know what they mean by "retaliatory" behavior. Generally, however, an employer isn't breaking any laws if he disciplines you without a warning, even if the discipline is unfair. You have not suggested that the employer had an improper motive for the discipline. You may be entitled to progressive discipline if your employment manual provides for it. I would first look at the manual and then take up the matter with HR.
