I have 50/50 custody with my sons father. I recently got assaulted by my ex boyfriend and I am moving out of state since he is threatening to kill me. I don't want to loose my rights to my son and want to have equal time with him even though I'm in another state. His father has recently agreed to keep him for rest of school year and summer and I get him next summer. But, his father is a recent addict and haven't really gone through the right counseling to be cleared. I worry. Any help would be amazing
When trying to modify parenting time the court looks at the Arizona revised statute 25-408, 25-403 and 25-411. That is what the court has to base its ruling on. I would highly recommend that you take your last court order to an experienced family law attorney to review.
As attorney Cotter stated, the court looks at those statutes to determine whether a child may be relocated outside of Arizona. It is important that you comply with any of your current orders and with ARS 25-408 specifically. ARS 25-408 is commonly known as the "relocation statute" and requires that notice of an intended relocation be given to the other parent in a very specific way.
