My son's mom is a stay at home mom with three kids total--1 is ours. Our son is barely 1 year old and his mom says that she "works 10 hours" a week for a multi-level marketing company making $500/mth. How will the child support court determine that she is/is not going to continue to be a stay at home mom and have/not have to seek "real" employment"? She is capable of working, but choosing to only work 10hrs/week--she has a bachelor's degree and sufficient work experience in the field.
Also, what are the chances that the judge would approve of a request to work order if I were to ask for one?
You might consider the potential cost of childcare because once she is working a regular job you would have to pay 1/2 and it may be substantial for an infant. You can however request a 'seek work' order for her.
