You should be given a court appointed attorney.
All of Ms. Straus’ responses posted on Avvo are intended as helpful information, based solely upon the facts stated in the question, and are not to be relied upon as a full or complete legal opinion. It may not be what you wished to hear, and it does not create an attorney-client relationship. Ms. Straus has been licensed to practice law in California for 33 years. Ms. Straus regrets that she does not provide follow up free advice via email. Good luck.
If they ask you to get a restraining order against your husband in the prior preceding but you didn't, then they think you are "failing to protect" the children. If they didn't ask (and even if they did) you really need to discuss this with your court-appointed attorney and your social worker. All you can do now is cooperate in every way and do whatever is necessary to get them back - which apparently means separating from your husband. Tough choice.
I agree with other counsel. You should talk this over with your court-appointed attorney. Because of the Cps detention, the case should come back to court today if not sooner. If Cps made a mistake, your attorney will know how to move things to so everything sorts out. If it wasn't a mistake, your attorney should be able to advise you as to what you can do to get your children back in your care again. I hope it all works out well for you and your family.
