car is in body shop. unsatisfied with work. insurer cant help. should I take legal action?
More details would be needed to determine if you had a legal claim. For example, if they used used parts but charged you for new that would be a claim. Finishing the work a day later than the estimate, not so much.
I agree with Mr. Levine - more details are necessary before any sound decision can be made to take legal action, although I can tell you that SUBJECTIVE (as opposed to objective) dissatisfaction with work, in the absence of a written warranty or customer satisfaction guarantee, is usually NOT a basis for recovery. In addition, hiring an attorney, depending upon the amount of work involved here, could very well be inefficient/not cost-effective for you.
As such, since your question comes out of the Bronx, I recommend contacting New York City's Department of Consumer Affairs ("DCA"). See http://www.nyc.gov/html/dca/html/home/home.shtml. See what DCA has to say about your case and what they can do for you with respect to working something out with the body shop. The Office of the Attorney General may also be able to assist you here. See http://www.ag.ny.gov/bureau/consumer-frauds-bureau.
