We currently have a notice of lien on our property from our HOA. We were never notified of the possibility of lien and has been 6 months since filed with court. We are putting our house on market. Can this lien be paid at closing? What steps should I take to not mess up the sell of our home?
First, the HOA must follow certain steps in order to file a lien. You might be able to challenge the validity of the lien, however, the HOA will likely have an opportunity to repair any defects in their lien, so unless you disagree with the amount of the lien, this is likely pointless.
You can settle the lien by paying it before closing. You can settle the lien with proceeds from the sale at the closing table.
