Hi, I’ve caught shoplifted about 7years ago and i was 22 years old. i know it was big bad mistake in my life and it was first and last. I did paid fees, did service & took a class that court wants me to. Is that record still on my record...? If yes, i want to expunge this record.. I don’t want people see that record and it is obstacle when i find the new job. Kept try to find the company who don’t check the background and that kind of company is small business... All the big company wants to check the back ground, that’s why i don’t apply to them. Please advise what i can do. Thank you!
Were you sentenced under the first offender act? If not, you may be able to apply for retroactive first offender treatment.
Unfortunately, you can't get a conviction expunged in Georgia. However, you may have some rights against employers who have run a background check on you, refused to hire you because of the conviction and then failed to comply with the requirements of the Fair Credit Reporting Act. Yes, employment-related background checks are covered by the Fair Credit Reporting Act.
