Rental car in my name. Wife was driving in Phoenix. Nice pictures of her from the traffic cameras. Am I correct that I have to be served within 120 days, or the issue is dropped? Will they try to serve me in NJ where I live? Will the NJ motor vehicle department be notified if I don't respond to the summons and if I avoid service?
If she wants to fight it (she was moving with traffic below the speed limit, and her entrance into the intersection was just a third of a second after the yellow light turned red) how does she do it from NJ?
If she pleads guilty, can she avoid notification to NJ Motor Vehicle Dept by taking some type of driving course? If so, how does she do this from NJ?
I appreciate any help you can offer.
If you want to fight the citation, then you need to hire an attorney in Phoenix. That attorney can appear on your behalf in the case. You will most likely not be compelled to actually go to court.
Not dealing with this civil citation will result in a default judgment against you. These could be reported to your local DMV and could result in points on your license or revocation of license.
