My son is a little over 2 and his father isn’t on the birth certificate, the first year of the babies life was spent in New York while me and his father were together the second year was spent in Florida and his father came to visit once for a 5 day period. I’m planning to move to South Carolina already leased a 2 bedroom apartment and now his father is starting to file for custody in New York. I’m not sure how to go about all this being I plan to live in a different state even though the baby has lived in a different state most of his life.
Its not clear where the child lives or has lived for the past 6 months. You need to speak to an attorney about relocation. If NY has jurisdiction then you have a battle on your hands and would need to show that it is in the child's best interest to move. Please speak to an attorney asap.
