My daughter in law stated in her will that she wants my son to be the executor. Knowingly that he is not qualified because of incarceration. She also named another person as executor if he is mot qualified. She left my son insurance policy, money in the checking and savings acct. My son appointed me his power of attorney to represent him. The other named executor already tried to get his money out the bank and they will not tell what the name of the insurance company
Is the savings and checking part of the estate and can she get the money out the bank for her own personal use.?How can i get her to tell me the name of the insurance company. This is s two part question
Bank accounts often pass outside the estate if it was a jointly owned account. If not, it is part of the estate and will require probate. It is more common for insurance to pass outside the estate to a named beneficiary. Unless the estate it named as the beneficiary, it is likely not going to be a part of the estate.
