I'm Chinese. My son was born in Los Angeles and soon after which we came back to China. I divorced with the child's father through Chinese court. I've lost contact with him since five years ago. Every serve during the divorce process was done via formal publish/announcement on newspapers. Our divorce decree is also being published on newspaper at the moment. That is to say I cannot get contact with the father and have no idea where he is. I want to change my son's family name to mine. I have three questions: 1. Can I do it in China with the US embassy? 2. If I must go to the US court what form shall I file in order to do it on my own? 3. The child's father did not show up in two of our court hearings in China and the court did not find him. Is this evidence enough to show that I can't find the child's father? Thank you very much!
China has jurisdiction so you should be able to do it but you'll have to check with an attorney in China as to the notification requirements.
