I once lived in Orleans county with the father of my child, four years ago. Since than, I moved to another county and gave birth to our second child together. Since a custody battle was already in place in Orleans county we settled there. Since than, my child father has took me back to court and filed again in Orleans county. I have not lived in that county and over 4 years. The last custody agreement was done over two years ago. Our second child has not even lived in that county. How do I file motion to change venue. Currently representing myself.
You would make the motion pursuant to FCA 174 which can be found at:
The motion would consist of a Notice of Motion and an Affidavit in Support of the Motion with any exhibits attached thereto.
The motion would be filed in family court and served upon the other party.
