My husband and I came onto bad times a few years back and ended up getting evicted. The landlord won the case and we paid the balance off. We have been in a new place for 2 years but would like to find something new. But what we're finding is it's beco
ming very hard due to the prior eviction on our record. So what I'm wondering is, will we be able to get it expunged since the landlord was in the right?
Unfortunately, based on the few facts you present here, it does not sound like you would be eligible for an expungement. Expungements are usually denied if the landlord wins and a judgment is issued against you.
There may be things you can do such as adding a statement to your tenant screening record explaining any evictions on your record. However, these steps can be time consuming and may involve some cost.
Here is a good resource to get you started: http://www.lawhelpmn.org/files/1765CC5E-1EC9-4FC4-65EC-957272D8A04E/attachments/37035BCB-B4A7-4D95-85D8-AF6FD48529E4/h-04-tenant-screening.pdf
Best of luck.
