I received a summons and am being sued by Tower Loan company. I fell behind on a payments and they refuse to except anything less than the amount due. My balance is $724. I have tried and tried to negotiate, all requests have been ignored. I am trying to make this debt right and pay but I am supporting my family of 4 on $2000 a month and I can not pay them the lump sum and survive. All I have been requesting is some sort of payment plan but the company seems determined to sue and garnish my check. How should I answer the summons? I know I owe this money and I do not want to go to court but I really can't afford to be garnished. I just don't want to waste my time if its going to end with being garnished regardless. Can anyone help?
If you go to court it is possible the creditor would be willing to accept a judgment and payment plan. This is usually referred to as the settled paying docket. If you miss a payment, then they are free to come after the full amount. I wish you the best.
