An email was sent to a supervisor (of plaintiff) stating that in the defendants perception the plaintiff showed a lack of leadership, was not a role model and was did not support skill development. Incidents supporting these comments can be brought forward from defendants perspective. Can a defense of opinion be asserted? Would this be a strong defense and/or have a high potential for dismissal?
Alternatively, can the absolute defense of truth be asserted--or would this be invalid in that any incidents brought forward may fall under the realm of opinion as to whether or not they demonstrated these assertions (which would correlate to the opinion defense comments above).
