So my house was raided, they found 114 marijuana plants, about 10 of them were not on my property, my first offense, my father-in-law was cultivating it, I'm getting charged with possession because my name is on the property tax bill, house is not in my name tho, can I ask for a felony diversion? I am in the state of Hawaii and I'm really scared, please give me all the advice you can. Am I screwed? Am I gonna do jailtime? I'm out on bail right now, please help.
Can't predict at this point whether or not your will receive jail time as it depends on many factors. You need to immediately consult with a local criminal attorney for review your case and discuss options. Early intervention into you case by an experienced attorney can have a huge impact on the outcome. Negotiation may be possible. Make a few calls right away.
Look, this is a forum in which you can ask about and get general information. The specifically tailored advice that you need must come from an attorney who has learned all of the facts and circumstances and has made a determination regarding viable defenses and potential motions. You need someone on your side who has decades of experience in criminal defense. Go have a discussion with one, at least, and find out whether you have the ability to hire one. If not, and you are indigent, you can ask for the public defender to be appointed.
