My husband was asked to leave the country after he lost his case. (DWI and cancellation of removal). He left and wants to know in how long he will be able to get his documents since his dad is a resident. He went to the American consul in Mexico, but they told him they don't have any information.
His father being a permanent resident does him no good, as does going to the US consulate. You /he needs to consult with a Board Certified immigration attorney to find out what his options are.
If and when his father becomes a citizen he should be able to petition for him. However one would also need to review your husbands immigration history. I suggest you take his immigration file and talk to a qualified immigration attorney in your area. You can do a search on avvo. The attorney should have worked on waiver cases and should have grasp of the implication of the removal.
