My dad died intestate and I'm his only child. There are 300 acres of community property, my stepmother is on the deed with him. Will I inherit 150 acres or 75? I have consulted a few attorneys and have been given both answers except their answers are always in terms of 1/2 the undivided interest or 1/2 of your dad's interest which makes it confusing to the lay person. So I'm not sure if I inherit 150 acres or 75 acres?
Your father and your stepmother each owned an undivided one-half community property interest in such property while both of them were alive(assuming such were in fact community property, and when your father died you would inherit his undivided one-half interest in such property. You and your stepmother could agree to partition such property so each of you owned 100% of a certain number of acres. tp protect your interests, you should hire a probate attorney.
