That's assuming he doesn't have prior felony convictions, which might increase the possible punishment. Actually, come to think of it, if he does not have any prior felony convictions, and thi is for less than a pound of marihuana, he's actually not only eligible for probation, he's guaranteed probation--whether it's likely that will work out for him or not, and regardless of whether he gets jail time on the ACBI. He can receive some jail time as a condition of probation, and he can be revoked the first time he messes up, but if there aren't any felony priors involved, he'll get probation.
