There is no 288a(B)(1). If you meant PC 288a(c)(2)(B), that is if you orally copulated a child under 14 years of age, you'll get, if convicted, 8. 10 or 12 years in state prison plus at least one strike and do 85% time. If by PC 289(H) you meant 289(h) you would get a much lesser sentence ranging from a misdemeanor to a state prison term of 16 months, 2, or 3 years.
When you cite statutes it is important that you do not use upper and lower case items indiscriminately. The case of the letter usually marks a different offense under the statute.
The exact penal code sections you provide do not exist. I did find the following:
288a. (a) Oral copulation is the act of copulating the mouth of one
person with the sexual organ or anus of another person.
(b) (1) Except as provided in Section 288, any person who
participates in an act of oral copulation with another person who is
under 18 years of age shall be punished by imprisonment in the state
prison, or in a county jail for a period of not more than one year.
289. (h) Except as provided in Section 288, any person who participates
in an act of sexual penetration with another person who is under 18
years of age shall be punished by imprisonment in the state prison or
in the county jail for a period of not more than one year.
The phrase "imprisonment in the state prison" is a term of 16 months, 2 or 3 years. The sentences could be served concurrently [at the same time] or consecutively [one after the other. If to be served consecutively, the second sentence would be 1/3 of the 2 year mid term or 8 months. Potential total exposure is 3 years and 8 mos.. Additiionally, conviction of either count will require registration as a sex offender.
As Mr. Kaman stated, be very careful when making references to code sections. Whether or not a letter is upper or lower case [ A or a] and is or is not in parentheses [ () ]. It can make the difference in finding the code section you are really concerned about.
