I would like to depose the defendant. My hope is to depose her very soon. I want to request that she appear for the deposition with documents. How many days notice am I required to give her in order to also ask for the documents to be produced at the time of her deposition? Our civil case is in Superior Court in Massachusetts.
In Massachusetts Superior Court State court, if you want to require a PARTY to bring documents to a deposition, a PARTY s entitled to 30 days notice to bring documents. A party is entitled to 45 days to answer written interrogatories. Below is a link for a good manual on Massachusetts rules.
