There is a statue of limitation for which the DA's office must indict a case. However, it is not 90 days. The individual needs an attorney. Aggravated assault is a very serious charge.
Ok, so there are two different things. The statute of limitations is four years for most felonies in Georgia. Where I think you are getting confused is, the DA has 90 days to indict a case if the defendant is in custody. If they are not indicted within 90 days the defendant is entitled to bond as a matter of right. It doesn't have to be a bond that that the defendant can afford, but it has to be a bond. They do not have to drop the case, if not indicted within 90 days.
