I have filed Bifurcation, OSC: Contempt of court order and served those papers to other party. It has been more than 30 days and they haven't filed any respond. What is the deadline for other party to answer those 2 motions? My case is in San Jose, CA. I have filed the paper with the court and served other party on 2/10.
The time to Respond has passed. When you go to court, your termination of the status will be granted. The Contempt is another issue. In family law, that is a semi criminal issue. You will need to show that she has been properly served. The court may issue a bench warrant for his or her arrest. and continue the matter.
Attorney Jones is correct, the time to respond has passed on the bifurcation. As for the contempt, the court will handle that.
