My friend was arrested on shoplifting and probation violation and they also booked her on a dui from months ago. She went to court today, they have taken off the shoplifting charge and she has a higher bail for the past dui charge now and no bail for her probation violation. How long will she be in the county jail?
It is difficult to guess based upon these facts. What is the underlying charge for the probation matter? She may serve the entire suspended sentence on that one. The DUI if it is a misdemeanor, will depend on how many prior DUIs she has had because the minimum sentence for each one is different. If it is a felony dui then she's looking at years instead of months. Good luck.
The response above is general information related to law and not intended as legal advice since it’s impracticable to provide thorough, accurate advice based upon the query without additional details. It is highly recommended that one should seek advice from an attorney licensed in your jurisdiction by setting up a confidential meeting. Moreover, this response does not constitute the creation of an attorney-client relationship since this message is not a confidential communication because it was posted on a public website, thereby publicly disclosing the information, which is another reason to setup a confidential meeting with an attorney.
What happened in the DUI? Was it a misdemeanor or a felony? Was anyone injured? What was her BAC? Was it a first DUI for her? What is her prior criminal history? Was any child in the car with her?
Depends how much time the judge imposed. Go look at her court file or ask her what happened in court.
