I recently found out I have a warrant and have been charged with unlawful use of a bank card which is being charged as a felony.
How long can that charge and warrant remain open and how do I fight it. This charge was filed in 2013
The warrant will remain open until you deal with it. It will not expire with time. You deal with this by hiring an attorney or going to the Office of Public Defense, 3000 Rockefeller Ave., Everett, WA 98201, and requesting a public defender. Your attorney can put you on a warrant quash calendar and help you figure out what your options are for fighting the charge.
Statute of limitations deals with the length of time for the State to file the case against you. So that has nothing to do with you because you have been charged. The warrant keeps the speedy trial rule in limbo until you appear and deal with it. It will never just go away.
