Have you found fresh droppings or seen live rodents? There is no set time frame, but if you feel there is an active infestation you could certainly call the city or county building inspector. I think they are still within the "reasonable" time assuming you have not seen new droppings or live rodents. Put your request to the landlord in writing if you have not done so already.

Under N.C.G.S. § 42-42(a)(8)(k), an "imminently dangerous condition" exists when there is "[r]at infestation as a result of defects in the structure that make the premises not impervious to rodents." When this is the case, the landlord has "a reasonable time" to cure the habitability defect, after the landlord has "actual knowledge" of the same. Now that the landlord has knowledge of this issue, I think anywhere from one to two weeks would be considered "reasonable" given that the landlord will likely have to coordinate with an exterminator to resolve this; if this is taken care of during that amount of time since the landlord's cognizance of the issue, there is not likely any liability on the landlord's part for breach of the implied warranty of habitability. If the landlord does not act reasonably promptly on this, however, or neglects the more general obligation, under N.C.G.S. § 42-42(a)(2) to make repairs and keep the premises "fit and habitable," liability will accrue to the landlord, and the tenant's remedies (assuming a private demand for rental discounts are not acceded to), is to pursue rent abatement damages by filing a lawsuit in small claims court. The magistrate in that situation will have discretion to determine what the diminution of fair rental value of your home is based on the rodent infestation, and any other habitability defects that fall under N.C.G.S. § 42-42. If needed, retain a local real property or landlord-tenant lawyer to advocate for your interests, and if cost is an issue, consider contacting the Raleigh office of Legal Aid of North Carolina.
