I filed for modification to child support 21 days ago and non-custodial parent has not answered. Can I file for a default judgment? If so what will happen next? Court date scheduled for May 19th.
There is no default involved in a hearing for a modification of child-support. The response is due I think nine Court days before the hearing. You can look it up on the court rules on your county court website. But no, you cannot do anything until the hearing and then you can only do what is ordered by the judge.
This is general advice. You are anonymous. If you PM me i won’t know what it’s about.
