My appeal is set to be heard on December 3. There are 4 judges hearing cases that day and there are 50 cases. My lawyer said that typically the judges have already reached a decision prior to oral arguments. Is that a fair assumption? How long before I have an answer on my appeal?
I would say that judges typically lean a particular way prior to oral argument because they have considered the parties' written briefs before then. Oral argument is often used by judges primarily to ask questions and gain some clarity from the attorneys with respect to grey areas. PA Superior Court Decisions are typically rendered between 2-6 months after argument but there is no limit, as Mr. Isquith mentioned.
