If you have lived in NC more than the past 6 months and have lived separately for more than the last 12 months, you can get a divorce. The fact that there are children has nothing to do with how long it will take to get a divorce. If you meet the foregoing criteria, you can file for divorce Monday and, assuming you will be able to get your wife served, should be able to be divorced by September or thereabouts. if there are custody issues, those will have to be handled separately in the children's home state, that is, the state where they have lived for at least the last six months generally. If that is NC, then you can file for custody here along with divorce, but the divorce can be entered prior to the custody matter being finalized. If the home state is NV, then there is where custody matters will have to be determined.

Make certain all other marital claims are dealt with prior to obtaining a divorce
