MY son was arrested for DUI. Blew a .09. Taken to the hospital for a blood test. No idea of the result. Taken to the jail and booked. Placed in the drunk tank for 20 min and released. Why did they let him go without a judges order? This all took place between 1;30am and he was released at 3:30am.
It is not uncommon for the jail to release DUI offenders relatively quickly. Provided they have no outstanding warrants and did not refuse any tests. A .09 is a winnable case. They likely took him in for the blood test because they thought he had something else in his system other than alcohol. Obtain a good attorney quickly because this Case sounds like it could result in a “not guilty” - and everything could then be expunged from his record.
