My brother is being held in county jail for over a year with no indictment, hearings ect. He was appointed a public defender however he says the feds are picking it up . I’ve called everyone up to the FDA like I was told and no one knows ANYTHING! My mother had a free consultation with lawyer whom also seen my brother and even then the county he is being held in can’t offer any insight to anything ! No one knows nothing ! Any info or help would be great
The feds have as much time as the statute of limitations to indict him. For most crimes, the statute of limitations is 5 years. While he is waiting for that to happen, his state case should move forward. His public defender is the person who can explain what is going on.

The answer is based only on the information provided, and may be inaccurate in the context of additional facts that have not been provided. The questioner should be aware that I am only licensed to practice law in the state and federal courts of Minnesota. Accordingly, before taking any action or refraining from taking any action, the questioner should consult with an attorney licensed to practice in his or her jurisdiction.
Your brother and his lawyer are the best sources of information. You are not going to get information from federal agencies or prosecutors; they generally do not announce their plans to relatives of the accused.
It may be that your brother does not want to share what's going on with you. It may also be that there are some negotiations taking place that you know nothing about. I really don't know, but that scenario happens frequently.
Sorry I can't provide additional information, but this is really up to your brother to address. Good luck to you both.
The response I have provided is general in nature, and does not create an attorney-client relationship. My practice is based in Rhode Island, and the law and practice in other states or jurisdictions may be different.
