A man was living with me, he left on thanksgiving. He was suppose to come back and chose to stay in another state. I've asked him to come get his stuff, he tells me he will when he can. I need to know how long I need to keep it for and if I need to do anything else before throwing it away.
I'm sorry to hear about your situation. Florida Statute Sections 715.10 - 715.11 provide a process you can go through to deal with his personal property. If the man was a former tenant, you would use the statutory form notice in Florida Statute 715.105. If the man was not a former tenant, you would use the statutory form notice in Florida Statute 715.106. You would mail the appropriate notice to the man at his last known address which would give him 15 days from when the notice is deposited in the mail. If you believe the property is worth less than $500, it may be kept, sold, or destroyed without further notice if the man fails to reclaim it within the 15 day period. Otherwise, his personal property would need to be sold at public sale by competitive bidding in accordance with Florida Statute 715.109.
