How long do I have to file a lawsuit against DHS and the foster care guardian for my children's injuries while in foster care? DHS did not take an appropriate amount of time to conduct an investigation and later stopped me from gathering evidence.
Well, if you are short on evidence, the Statute of Limitations question may not matter. You should have the case reviewed immediately by an appeal attorney. In many cases, the statute does not run until the child is 18. I only give specific advise to clients who actually present me with a case. However, the best advice is always to move quickly.
In answering this question, it is not intended that an attorney-client relationship is formed and the information is for general reference only. I am licensed in Michigan and Florida and offer no legal advice outside of those states.
Whenever a statute of limitations is in question, consult with an attorney immediately. We are unable to provide that answer here based on lack of information presented.
