My guy gave a fellow loan. On the day he was asked to come get the money, he was set up. The guy picked up fight with him, pouched him in the face and my guy hit back. The guy called police. My guy was arrested. But the guy fled never showed up for court. Case was dismissed.
But my question is, can he sue for false arrest or its top late ? and it's been like 6 or 7 years now. I just got to know of your last year. This happened in NYC.
Nothing about what you described indicates a 'false arrest'.
Case dismissed does not mean your guy was innocent or that police did anything wrong.
The statute of limitations is long expired. It was one year against the guy who set him up and the longest against the police was three years under federal law.
