Obviously, more information is needed. Therefore, you will want to have a consultation with an experienced Michigan Criminal Defense Attorney who practices in the Federal Courts. He or she will meet with you and review the search warrant documents and contact the appropriate FBI agent and/or Assistant United States Attorney to determine why the government is still holding the property and what if anything you can do to get it back, short of a lawsuit.
THE WOLF LAW FIRM would be available to assist in this matter after a formal consultation to obtain all necessary facts and review all pertinent documents. THE WOLF LAW FIRM practices in all state and federal courts in Michigan. An attorney-client relationship with THE WOLF LAW FIRM or Answering Attorney is not established until and if a written engagement agreement is executed by all parties and an agreed upon retainer is tendered. In the meantime, please consider this response as a general answer for the benefit and entertainment of the public. We wish you the best. Thank you.
If the property is not contraband, (or something illegal), you may ask the officer in charge for return. If appeals are exhausted, you should get the property back. If not voluntarily given, you could file an action to get the property back. Some Courts require a claim and delivery action. You should seek an attorney near the Court involved.
