I have a friend that has been staying with me for a month and I did not think I had to ask the mgmt if my friend could stay for a month. I ran into mgmt and I couldn't give answers as to when my friend would be leaving and she only said that she didn't tolerate it anymore, which I don't know what that means. What is a reasonable time you should be able to have a guest stay? I feel like she is discriminating against me, bc she e has guests stay for a month or more and also 5 people are living in a one bedroom apt and I've seen other tenants with guests for 2 months and this is my first time having someone stay and other tenants that have more than 2 people in one bedroom apts.
Most leases have restrictions on having guests, as well as separate restrictions on subleasing. If your lease has such restrictions, and you are violating the guest and/or subleasing restrictions, the landlord can serve you with a 3-day notice to cure or quit, and then file an unlawful detainer lawsuit against you if you don't comply.
The fact that the landlord may not treat all tenants the smae probably doesn't matter, so long as the landlord is not unlawfully discriminating (e.g. on the basis of race or religion).
You may wish to consult a local landlord-tenant lawyer about this, including to interpret the lease restrictions.
