Ordinarily, DUI - generally a misdemeanor offense - is not indicted, but simply charged by use of a Uniform Traffic Ticket and Complaint (U.T.T.C.). However, a fourth offense DUI in the past five years [since amended to ten (10) years as of July 1, 2018] is treated as a felony offense. All felony offenses in the state of Alabama require an indictment. If you had three prior misdemeanor DUI convictions at the time of the last arrest and those convictions took place during the five previous years, then it is possible you are facing a DUI felony. The issuance of the U.T.T.C. would have tolled the statute of limitations. If your last DUI arrest was presented to the grand jury for indictment, ordinarily, you would have been indicted by now and the case assigned to the circuit court. Your best course of action is to seek the professional legal services of a qualified criminal defense attorney to assist you in this matter.
