To establish abandonment, you would be required to show the abandonment lasted at least 12 consecutive months. You must also show the abandonment was malicious and willful, as opposed to accidental or involuntary. A claim of abandonment will likely fail if the other spouse had been on life support in a hospital, for example, because that spouse had no choice in the matter. Finally, you would be required to show there is no reasonable possibility, under the circumstances, for the couple to salvage their marital relationship. Given the fact that you have a Dissolution of Marriage in progress, I would suggest you consider seeking Temporary Relief. If you do not have an attorney involved, I would urge you to attempt to engage one.
