My bank account was garnished by a creditor. All funds to pay off creditor is on hold and has not yet been released. Now my pay check is also being garnished. The money garnished from my pay check shouldn't have been garnished. I was under the impression that funds were supposed to been released December 16.
After the funds are paid to the court, the creditor will then need to move to condemn the funds. The creditor does receive the benefit of those funds until the court issues an order. There is no time certain or deadline for a judge to enter his or her order.
