I have a firs offense dui and I looked at the sentence guideline and the sentence that they are trying to give me is way above the guide lines
Theoretically you can withdraw the plea anytime prior to sentencing unless there is prejudice to the Comminwealth. As a practical matter you should be having these conversations with your attorney. Each jurisdiction is a little different in how they handle plea withdrawals. Additionally, if you dont have a defense withdrawing the plea could have an adverse affect on your sentencing. There may be other options short of withdrawing your plea. A skilled attorney is a valuable asset in this situation as they should be able to explain all of your options and the ramifications of each.
