My case is currently with BIA under admin closure due to PD.
I 130 approved
filing I 485 with uscis and want to terminate the case with bia, how likely is bia to do so?
You can file a motion to recalendar and terminate. If you can show a likelihood of success on the I-485, ICE Chief Counsel may not oppose termination. Otherwise, adjust at the immigration court.
The above is intended only as general information, and does not constitute legal advice. You must speak with an attorney to discuss your individual case.
The BIA will not terminate, yet it may re send the appealed case back to the docket for adjustment based on the One Stop package.
