I'm in an apt haven't paid rent in three months. The lease was in my moms name but has not been renewed in over since last year. Someone that manages the property id's saying they will sue many mom if I'm not out in seven days.
Your Mom is still the tenant at will and apparently has allowed you to live there without the landlord's permission and without you entering into an appropriate lease. She does not escape liability for any debt owed the landlord just because she allowed you to move in. As they say, two wrongs don't make a right. If your theory was correct, someone in default on their lease, or a holdover, could just pull someone in off the street to move in and take their place. That makes no sense. She may or may not have defenses to a lawsuit, but it is not just because she decided to give you the apartment.
Its called a "tenancy at will" if parties allowed a lease to lapse but continued the arrangement between the parties. She's on the hook for the rent, if you don't pay.
They are correct. Technically, your mother is their tenant. But, they must give her 60 days notice if this is a residential dwelling.
