There are many ways to indicate that something is private, and to make its receipt conditional upon accepting that fact. If I send you an email which is titled "PRIVATE PHOTO" it would be reasonable to understand that I want it kept private. If we have a history of exchanging material which is confidential, you would be expected to understand that anything so titled is not to be disclosed.
Basically, the answer to your question comes down to whether or not the sender and recipient reasonably understand that the photo is intended to be kept private, and that answer takes a lot more information that you provide.
