If police commit perjury in any part of my affidavit does it give me enough evidence to have a case thrown out if all the key evidence is perjury. Also how do I go about proving perjury. My final question is will any attorney work off a contingency style payment plan for a criminal case ? I’m really trying to save myself from going to jail for possibly 15 years on a fleeing and eluding Leo at high speed charge. But I have no money to come directly out of pocket right now. The bail and my bills have taken everything I have. I feel like a public defender won’t help me much and that he won’t try to find me innocent even though I feel strongly as if I have a strong case and key witnesses. This is a high ranking police chief committing perjury. I don’t know if someone might have good advice about a lawyer who can help me or any of my above questions. I’m a hard working citizen I really just need help. I’m sorry to vent I just feel like my life could be taken away over perjury. Our local agencies have no body or dash cam I already tried to get copies. I do however have arrest affidavits not matching up. I was also never read my rights before questioning.
Was it a material misstatement?
I do not feel the public defender.... What experience do you have that you based your opinion on to state that.
It is not the obligation of a defense attorney to prove his/her client innocent. The prosecution must prove the defendant guilty based on proof beyond a reasonable doubt.
It is a violation on Bar rules to represent someone in a criminal case on a contingency fee basis. (same for divorce)
I agree with Mr. Kollin. Some attorneys may accept a payment plan, which is much different than a contingency fee. You can call someone in your area for a consultation and to discuss fees. Also, you may want to speak with them about the difference between perjury and impeachment material. The discrepancies in reports can be used to discredit the officers, but to prove a "high ranking police chief committing perjury" is another thing. Good luck.
