May I know what will happen if same employer file Multiple PERM applications for same person for similar title(& job description). Mine one PERM is under BALCA while we filed another new in December.
The Title & Job Description looks similar but they are not exactly same and also the minimum required skills are mostly different(80% different).
How will DoL react if they feel both the PERMs are same. Can they simply reject the new PERM or will they send notification to the Employer and ask them to withdraw one of the PERM?
Is this process got changed recently where DoL can simply reject the PERM application without asking the employer?
I am changing the practice area from Employment to Immigration to help you get an answer to your question. You should consult an immigration attorney that is familiar with this area of law in Virginia.
Please be aware that my answer discusses the law only generally and is not legal advice, nor does it create an attorney client relationship. You should not rely on answers in this Q&A without consulting an attorney authorized to practice law in your state to review the specific issues in your case. Keep in mind attorneys are not permitted by Avvo to ask for business here and our answers reflect that, but you may contact an attorney through their profile for a consultation. Thank you.
